BILLING, PRICING AND PAYMENT TERMS

This section contains policies and information about Letstrack’s billing policies, pricing and payment terms.


A. BILLING POLICIES

If you elect to use Subscription Features, you agree to the pricing and payment terms displayed at the time you elect to subscribe. LetsTrack may add new features for additional fees and charges, or amend fees and charges for existing services, at any time in our sole discretion. Any change to our pricing or payment terms shall only apply to you and become effective in the billing cycle following at least 30 days' notice of such change to you.

LetsTrack is not responsible for mobile data usage resulting from the use of the Services. Consult your mobile provider with questions related to billing, as data rate charges and limits may apply.


B. PRICING AND PAYMENT TERMS

1. Subscription Plans
LetsTrack offers the following subscription tiers:

Free Plan: Basic tracking features with limitations
Silver Plan: Enhanced tracking with additional tag support
Gold Plan: Advanced features including history replay and unlimited tags
Platinum Plan: Premium features with unlimited circles, places, and airport alerts

2. Subscription Fees and Auto-Renewal
All subscription fees plus any applicable taxes and other charges (the "Subscription Fee") are payable in advance, at the beginning of your subscription term, and at the start of each billing period thereafter, at the then-current Subscription Fee.

You may have the option to pay your Subscription Fee on a monthly basis (a "Monthly Subscription"), or on an annual basis (an "Annual Subscription"), or in certain cases, on a monthly basis with an annual commitment and an annual renewal date ("Annual Commitment Monthly Subscription").

Your subscription with us will automatically renew until you cancel it.

Monthly Subscription: We (or our third-party payment processor) will automatically charge you each month on the anniversary of the commencement of your Monthly Subscription, using the payment information you have provided until you cancel.

Annual Subscription: We (or our third-party payment processor) will automatically charge you annually on the anniversary of the commencement of your Annual Subscription, using the payment information you have provided until you cancel.

Annual Commitment Monthly Subscription: We (or our third-party payment processor) will automatically charge you each month on the anniversary of the commencement of your subscription, using the payment information you have provided until you cancel and the annual commitment lapses.

For Annual Subscriptions and Annual Commitment Monthly Subscriptions, we will send you a reminder at least thirty (30) days prior to each annual renewal with the then-current Subscription Fee. We may send additional reminders for other subscriptions as required.

We reserve the right to change our Subscription Fees for all subscription types. We will provide you advance notice of any increase in the Subscription Fees applicable to your subscription.


3. Changing Your Subscription
If you change or upgrade your subscription, your billing date may also change.

Upgrading from Monthly to Annual: On your next billing date, you will be charged the then-current Subscription Fee for an Annual Subscription, and your subscription will renew on an annual basis.

Downgrading from Annual to Monthly: If the option is available and you change to a Monthly Subscription, at the next renewal date for your Annual Subscription, you will be charged the then-current Subscription Fee for a Monthly Subscription, and your subscription will renew on a monthly basis.


4. Circle Subscription Application
If you purchase a LetsTrack subscription, you are able to apply the features associated with that subscription to one Circle on your LetsTrack account. Those features will be available for all Circle members in the Circle that you apply the subscription to, up to the maximum number of members allowed by your plan:

Free Plan and Silver Plan: Up to 2 members

Gold Plan: Up to 5 members

Platinum Plan: Unlimited members

Only one Circle member needs to purchase and apply their subscription to a Circle. LetsTrack is not responsible if members purchase multiple subscriptions and apply them to the same Circle.


5. Free Trial Period
After initial registration of a paid subscription ("Paid Subscription"), you may be given an initial free trial period ("Free Trial Period"). Certain features may not be available during the Free Trial Period, at LetsTrack's sole discretion.

You may cancel your account at any time during the Free Trial Period to avoid any additional charges.

If you do not cancel your subscription during the Free Trial Period, then at the end of the Free Trial Period you will be automatically charged for the price of the Paid Subscription type you selected during registration, and you will continue to be charged that amount until you cancel your Paid Subscription.

You are limited to one trial per person (credit card or other unique payment or identification method) during any twelve (12)-month period.

By accepting a Free Trial Period, you agree that, at the end of the Free Trial Period, you will be charged the then-current Subscription Fee for a Monthly or Annual Subscription, as specified in the offer for the Free Trial Period, and at the start of each subsequent billing period. You authorize us to charge you using the Payment Information you provided when you accepted the offer for the Free Trial Period.

We may validate your Payment Information and the payment method you provided by requesting a temporary authorization to the financial institution that issued your payment method. If we determine that your Payment Information or payment method is invalid, we may revoke your Paid Subscription and terminate your Free Trial Period.


6. Payment Methods
LetsTrack accepts most major credit and debit cards. LetsTrack also accepts in-app payments such as from third parties like Apple App Store or Google Play Store.

In the event that LetsTrack is unable to charge the card you have provided (e.g., expired credit card), LetsTrack will send you a notice to update your card information. You will have a seven (7)-day grace period to update your billing information. If the account is not updated within the seven (7)-day grace period, LetsTrack may terminate your subscription.

By purchasing a subscription (a "Transaction"), you expressly authorize us (or our third-party payment processor) to charge you for such Transaction. We may ask you to provide additional information relevant to your Transaction, including your credit card number, the expiration date of your credit card, and your email and postal addresses for billing and notification (such information, "Payment Information").

You represent and warrant that you have the legal right to use all payment methods represented by Payment Information that you provide us. You acknowledge and agree that we have no liability with respect to any act or omission by your payment provider.

When you initiate a Transaction, you authorize us to provide your Payment Information to third parties so we can complete your Transaction and to charge your payment method for the type of Transaction you have selected (plus any applicable taxes and other charges). You may need to provide additional information to verify your identity before completing your Transaction.

LetsTrack is not responsible for any charges or expenses you incur resulting from charges billed by LetsTrack in accordance with this Agreement (for example, overdrawn accounts, or exceeding credit card limits).

By providing a credit card number or other payment method with advance authorization features (e.g., in-app payments such as from third parties like Apple or Google), you authorize LetsTrack to continue charging the payment method for all charges due LetsTrack, including taxes, until your account is settled and your subscription is terminated by either you or LetsTrack.

LetsTrack reserves the right to limit the number of accounts that may be charged to a credit card or other payment or identification method per unique user.


7. Pricing Changes
Prices for subscriptions may change from time to time to reflect inflation or changing business requirements. If they do, and you currently have a subscription, LetsTrack will provide you with advance notice of the change via email (or if you have not provided a valid email address, through the Services or in another available manner) before the price change is to take effect.

If you do not want to continue at the new price, you can cancel the relevant subscription before the price increase takes effect by following the instructions in the "Cancel Your Subscription" section below.


C. REFUNDS

1. No Refunds for Subscriptions
You may cancel your account at any time in accordance with the "Cancel Your Subscription" section below; however, except as set out in the "Cancel Your Subscription During the Cooling-Off Period" section or where prohibited by applicable law, there are no refunds for any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with your account, or for anything else.

Upon canceling any features, your subscription will be valid and you will retain access to the features until the start of your then-current paid period is completed.

Example: If you purchase an annual subscription and cancel it two months into the year, you will not receive a refund for the remaining portion of the year, but will instead enjoy the features for the remaining ten months that you have already paid for.


2. Cancel Your Subscription During the Cooling-Off Period
If you are a consumer based in the European Union, European Economic Area, or United Kingdom, you have an automatic legal right to withdraw from contracts for purchases of paid subscriptions within fourteen (14) days from the date of purchase.

D. PAYMENT INFORMATION AND TAXES
All information that you provide in connection with a purchase or Transaction or other monetary transaction interaction with the Service must be accurate, complete, and current.

You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or Transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred.

You will pay any applicable taxes, if any, relating to any such purchases, Transactions or other monetary transaction interactions.

CANCEL YOUR SUBSCRIPTION OR DELETE YOUR ACCOUNT

A. CANCEL YOUR SUBSCRIPTION
You may cancel your Paid Subscription at any time, and the cancellation will be effective at the next renewal date. Note: Cancelling your Paid Subscription does not delete your account. To delete your account, please follow the instructions in section D below.

How to Cancel Your LetsTrack Subscription:

Option 1: Cancel in the LetsTrack App
1. In the LetsTrack app, go to Settings
2. Tap Account
3. Select Cancel Subscription
4. Follow the on-screen instructions to complete the cancellation

Important for App Store Users: If you signed up directly with the Apple App Store or Google Play Store, you must also cancel directly with Apple or Google to ensure your subscription is fully cancelled and that you will no longer be charged the recurring subscription fee. You can access the store cancellation from the last page of our in-app cancellation process.


Note for Website Subscribers on Android: If you purchased your subscription directly from our website (LetsTrack.com) and are using an Android device, you must cancel your Paid Subscription by logging in at LetsTrack.com. Follow the instructions below for "Cancel at LetsTrack.com".


Option 2: Cancel at LetsTrack.com
1. Go to LetsTrack.com and log into your account
2. Navigate to Manage Subscription
3. Scroll down to the cancellation section
4. Select the Paid Subscription you wish to cancel
5. Follow the on-screen instructions to complete the cancellation

Note: If you did not sign up through LetsTrack.com, you will not be able to cancel your Paid Subscription through LetsTrack.com and you must cancel through the LetsTrack app, and directly with the Apple App Store or Google Play Store if applicable. Follow the instructions above for "Cancel in the LetsTrack App".


Option 3: Cancel Through Apple App Store (iPhone/iPad Users)
If you registered with the Apple App Store:
1. On your Apple device, go to Settings 2. Tap on your name at the top
3. Tap Subscriptions
4. Scroll down to your LetsTrack subscription
5. Tap Cancel Subscription
6. Follow the on-screen instructions to confirm

Option 4: Cancel Through Google Play Store (Android Users)
If you registered with the Google Play Store:
1. On your Android device, open the Google Play Store app
2. Tap on your Profile Icon at the top right
3. Tap Payments & Subscriptions
4. Tap Subscriptions
5. Select your LetsTrack subscription
6. Tap Cancel Subscription
7. Follow the on-screen instructions to confirm

Important Reminders:
• If you purchased your LetsTrack Paid Subscription through the Apple App Store or Google Play Store, you must cancel your subscription directly with Apple or Google to ensure you will no longer be charged the recurring subscription fee.

• Cancellation will be effective at the end of your current billing period. You will continue to have access to your subscription features until that time.

• For additional help with cancellation, please visit our Help Center or contact our support team.

B. CANCEL YOUR SUBSCRIPTION DURING THE COOLING-OFF PERIOD
If you are a consumer based in the European Union, European Economic Area, or United Kingdom, you have an automatic legal right to withdraw from contracts for purchases of paid subscriptions within fourteen (14) days from the date of purchase.

C. SPECIAL TERMS FOR APPLE APP STORE USERS (EULA)
If you downloaded the LetsTrack app from the Apple App Store, the following additional terms apply:
1. Acknowledgement: You acknowledge that these Terms are concluded between you and LetsTrack only, and not with Apple Inc. ("Apple"). LetsTrack, not Apple, is solely responsible for the app and its content.

2. Scope of License: The license granted to you is limited to a non-transferable license to use the app on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services


Terms and Conditions.

3. Maintenance and Support: LetsTrack is solely responsible for providing any maintenance and support services with respect to the app as specified in these Terms, or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

4. Warranty: LetsTrack is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.

5. Product Claims: LetsTrack, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

6. Intellectual Property Rights: In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, LetsTrack, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the app (e.g., your wireless data service agreement).

9. Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

10. Contact Information: Any questions, complaints or claims with respect to the app should be directed to LetsTrack's support team, not Apple.


D. SPECIAL TERMS FOR GOOGLE PLAY STORE USERS
If you downloaded the LetsTrack app from the Google Play Store, the following additional terms apply:

1. Google Play Terms: Your use of the app is also governed by the Google Play Terms of Service, available at https://play.google.com/intl/en_us/about/play-terms/

2. Payment Processing: All payments made through Google Play are processed by Google. LetsTrack does not have access to or store your Google Play payment information.

3. Refunds: Refund requests for purchases made through Google Play must be submitted to Google in accordance with Google's refund policy. LetsTrack does not control Google's refund decisions.

4. Subscription Management: Subscriptions purchased through Google Play are managed through your Google Play account. You must cancel through Google Play settings to stop recurring charges.

5. Content Rating: The app's content rating on Google Play is determined by Google's rating system. By downloading the app, you acknowledge that you meet the minimum age requirements for the content rating.

6. Updates: Updates to the app distributed through Google Play are subject to Google's update policies and may be automatic depending on your device settings.


E. DELETE YOUR ACCOUNT
Important: Deleting your account, deleting the app, or leaving a Circle will not cancel your Paid Subscription. To cancel your Paid Subscription and stop any recurring charges, you must separately cancel your Paid Subscription as described in section A above.

Please be sure to cancel your Paid Subscription prior to deleting your account.

How to Delete Your LetsTrack Account:

Deleting your LetsTrack account will permanently delete all history, tracking events, and associated data. This action cannot be undone.

Delete via the LetsTrack App:
1. In the LetsTrack app, go to Settings
2. Tap Account
3. Select Delete Account
4. Review the information provided about deleting your account
5. Select "Yes" to confirm you would like to proceed
6. Tap "Continue"
7. We will send you an email to the email address associated with your LetsTrack account to authenticate your deletion request


8. Follow the instructions in the authentication email to complete the account deletion process Delete via LetsTrack.com:

1. Log in to your account at LetsTrack.com
2. Go to Manage Account
3. Scroll to the Delete Account section
4. Review the information provided about deleting your account
5. Select "Yes" to confirm you would like to proceed
6. Click "Continue"
7. We will send you an email to the email address we have on file to authenticate your deletion request
8. Follow the instructions in the authentication email to complete the account deletion process

What Happens When You Delete Your Account:
• All location history will be permanently deleted
• All tracking data and events will be permanently removed
• Your account details will be removed from the LetsTrack database
• Any devices or tags associated with your account will be deactivated
• This action is permanent and cannot be undone
